On October 29, 2026, Intercontinental Exchange, owner of the New York Stock Exchange, and Trade.xyz announced a definitive agreement to bring Trade.xyz’s perpetual markets into the United States, subject to regulatory approvals. ICE will exclusively operate the regulated markets and make a strategic investment, according to the joint release.
The proposed retail venue would use Hyperliquid infrastructure with a dedicated clearing structure, separate from ICE’s institutional futures and clearing operations. Reporting describes ICE’s investment as a minority stake with undisclosed terms; no launch date has been given, and the announcement did not disclose a CFTC application, as Unchained reported.
That leaves two distinct developments to follow: a proposed ICE-operated business and a nearer regulatory test involving competing US exchanges. The second has a November 2 deadline that could matter before ICE announces its first product submission.
What the proposed market would list
Planned contracts would reference equities, equity indices, commodities, foreign exchange and crypto. The intended route combines identity verification and anti-money-laundering checks with participating futures brokers; distribution is also expected through ICE’s OKX joint venture, subject to that venture’s separate approvals, as Markets Media reports.
ICE invested in OKX at a $25 billion valuation in March 2026, according to Cointelegraph. That existing relationship provides context for the distribution plan, but it does not establish permission to offer these new contracts.
ICE says institutional customers account for more than 99% of its current market participation. Its separate clearing arrangement is intended to keep retail trading and counterparty exposure away from existing commercial hedgers. The distinction matters when assessing the announcement: ICE is proposing a dedicated retail business alongside its established franchise.
CEO Jeffrey Sprecher framed the retail push directly: “We intend to find retail traders where they want to be, through the partners, brokers, and platforms they already use,” adding that ICE sees these perpetual markets as additive to its futures business rather than a replacement for it.
Why HYPE reacted
HYPE rose roughly 20% on October 29 and traded above $96, approaching September’s $97.96 record, according to CoinGecko data cited by Cointelegraph. Stanley Druckenmiller also publicly identified himself as an investor in Trade.xyz.
Trade.xyz says its Hyperliquid markets processed more than $650 billion in volume in just over a year, a company figure reported by Unchained. That measures activity in the existing markets; it is not volume generated by the proposed US venue.
A reasonable interpretation of the price reaction is that traders attached value to the possibility of wider regulated distribution. But a token price reaction is not a regulatory approval, and neither the investment nor the reported volume resolves the product-by-product review ahead.
The US rulebook is still asset-specific
On May 29, 2026, the CFTC approved Kalshi’s BTCPERP as a futures contract, announcing the decision in Release 9240-26. The approval order identifies its reference as the CF Benchmarks Bitcoin Real Time Index, or BRTI.
The accompanying Policy Statement appeared at 91 Fed. Reg. 33,160 on June 3, 2026. A separate staff advisory addressed 24/7 trading and clearing operations, including expectations for exchanges, clearing organizations and futures commission merchants.
The CFTC cautioned that perpetual designs may not fit every asset class and encouraged review under Regulation 40.3 for assets outside the order’s scope. Bitcoin approval therefore does not settle the treatment of equity or commodity perpetuals.
CME challenged the approval in CME v. Selig, arguing that these instruments belong under the swaps framework. The existence of that challenge adds a legal question; it should not be mistaken for a court decision overturning the approval.
November 2 is a conditional deadline
Kalshi, Bitnomial and Coinbase Derivatives submitted single-stock perpetual futures for approval on September 18, 2026; OG.com, a Crypto.com company, followed on September 24. Eversheds Sutherland’s analysis identifies a 45-calendar-day review period.
Absent CFTC action or an extension, the first three exchanges’ contracts would be deemed approved on November 2, 2026, and OG.com’s on November 8. These are conditional procedural dates, not promised trading launches or deadlines for ICE’s separate proposal.
All four exchanges also submitted security-futures listing standards to the SEC under Exchange Act section 19(b)(7). Certain precious-metal and securities-index perpetuals are already trading on US exchanges after deemed approval without an affirmative CFTC approval order.
The practical implication is that an approval announcement may not be the only evidence of regulatory progress. Readers need to distinguish an elapsed review period from an extension, and either from a venue’s actual opening for customer trading.
How US traders would gain access
The proposed ICE route requires an account with a participating futures commission merchant, or FCM, together with identity and AML checks. The release states that KYC/AML-verified customers are expected to reach the venue through FCMs that become members of the platform, and reporting indicates distribution will also run through the partners, brokers and platforms retail traders already use, per Markets Media. A self-custody wallet connection alone does not establish that customer relationship.
Contract specifications and venue margin rules would govern positions. Trading hours also require attention: Kalshi’s approved bitcoin contract provides for 24/7 trading, while the pending single-stock proposals generally contemplate continuous or near-continuous trading from Sunday evening through Friday evening. Those schedules should not be assumed to be interchangeable.
Offshore Hyperliquid and Trade.xyz remain closed to US users, as Bloomberg reports through Energy Connects. The proposal concerns access to a regulated venue using Hyperliquid technology, not permission for Americans to access Hyperliquid’s existing on-chain order books as such.

Tax treatment depends on the contract
For US federal taxes, spot crypto is property under IRS Notice 2014-21. Regulated futures traded on a CFTC-designated contract market can qualify under Section 1256, but the word “perp” does not establish eligibility.
The IRS identifies Form 6781 as the reporting form for Section 1256 gains and losses. Its instructions generally divide qualifying capital results into 60% long-term and 40% short-term amounts, carried to Schedule D, and apply year-end mark-to-market treatment.
Those instructions also exclude securities futures generally while separately recognizing dealer securities futures. Retail single-stock perps therefore should not automatically inherit the tax treatment associated with qualifying commodity futures; the contract and exchange matter.
Form 1099-DA concerns broker reporting of covered digital-asset sales. It is not a replacement for Form 6781 reporting on qualifying futures, and receiving a digital-asset information return does not itself establish Section 1256 status.

What to watch
Watch for an ICE–Trade.xyz CFTC filing or product submission, and for action or extensions affecting the November 2 and November 8 deemed-approval dates. Also monitor whether the SEC raises equity-market concerns about single-stock perpetuals, particularly their effects on liquidity and price discovery.
