The October 20, 2026 deadline in CFTC Staff Letter No. 26-29 has passed, closing a temporary procedural window for certain US futures contract conversions. It did not automatically authorize every cryptocurrency perpetual or convert every outstanding position. The distinction matters: the relief specifically addressed existing broad-based security index perpetual-style futures, although Coinbase Derivatives’ request sits within the larger development of regulated perpetual markets. CFTC Release 9308-26
For traders, the substantive opportunity is a familiar trading instrument inside a different legal structure. No-expiry exposure can coexist with US exchange supervision, central clearing, customer-fund protections, and potentially favorable federal tax treatment. Each benefit depends on the actual contract and account—not simply the word “perpetual” on a trading screen.
What the October 20 deadline actually ended
The Division of Market Oversight announced the relief on October 5. The underlying letter bears an October 3 date and responds to Coinbase Derivatives, LLC’s October 1 request. It allowed qualifying amendments without the standard ten-business-day waiting framework under Commission Regulations 40.6(a)(3) and 40.6(b)(1). Footnote 25 expressly excludes contracts referencing assets other than broad-based security indices. Staff Letter 26-29
The conditions were substantive: solicit feedback from holders, give at least five calendar days’ notice, allow exits under existing terms, supply risk disclosures, and change no other material terms. Exchanges still needed appropriate filings and certification of compliance. These requirements protected customers whose positions would otherwise acquire a different contractual lifespan without meaningful preparation. Staff Letter 26-29
The legal reading after October 20 is therefore that this particular expedited reliance window has closed. The expiration clause does not itself unwind compliant conversions, and it supplies no continuing shortcut for new amendments. Staff no-action relief is an enforcement position, not a permanent Commission rule. Staff Letter 26-29
An exchange’s effective contract specification and amendment notice remain essential evidence. A deadline in a regulator’s announcement cannot establish which individual products changed or when a customer’s position was converted.
True perpetuals change the economics of holding exposure
A perpetual-style contract can resemble an offshore perpetual while retaining a distant maturity. Coinbase’s legacy overview describes five-year contracts expiring in December 2030. Its separate current perpetual overview describes no-expiry contracts with hourly funding. Those descriptions demonstrate why traders must distinguish product generations rather than assume every Coinbase futures instrument has identical terms. Coinbase perpetual-style overview, Coinbase perpetual overview
Removing scheduled expiration eliminates the routine need to roll into another maturity. Funding payments help keep the futures price near the underlying spot reference, but they introduce a variable carrying cost. A long position can be directionally profitable while repeated funding charges erode its return. Conversely, receiving funding does not make an offsetting strategy riskless.
Consider a hypothetical $100,000 position paying 0.01% each hour. That equals $10 per hour, or $240 over 24 hours, assuming unchanged notional and funding. This is an illustration, not a quoted market rate. It shows why an apparently small funding number deserves the same scrutiny as commissions and bid-ask spreads.
No expiry also does not promise indefinite availability. Delisting, emergency measures, liquidation, and contract termination provisions still matter. Coinbase’s published settlement mechanics explicitly contemplate exchange termination of trading. Coinbase settlement mechanics
CTX and CAM are a separate regulatory track
Alongside these product developments, the CFTC published its advance notice of proposed rulemaking for Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets on October 13, 2026: 91 FR 64811, RIN 3038-AF80, with comments due December 14. This is an ANPRM, not an effective final regulatory framework. Federal Register notice
The statutory anchor is Commodity Exchange Act Section 2(c)(2)(D), addressing certain leveraged, margined, or financed retail commodity transactions. Its exceptions, including actual delivery within 28 days, are important to determining coverage. The notice explores how that framework should apply to crypto transactions; holding a balance on an exchange’s internal ledger should not simply be equated with completed delivery. Federal Register notice
The agency also seeks input on a crypto asset market registration subcategory within the DCM framework. Chairman Michael S. Selig presents the initiative as part of building a national regulatory approach. For market participants, the immediate task is evaluating and commenting on potential rules—not treating proposed CAM status as a license already available to every platform. CFTC Release 9307-26
Section 1256: a material advantage with precise boundaries
US DCM crypto futures can qualify as regulated futures contracts under IRC Section 1256 when their margin amounts depend on daily marking to market and they trade on, or are subject to, a qualified exchange’s rules. A CFTC-designated domestic contract market meets the exchange criterion. Qualification turns on the legal instrument; CFTC oversight alone is not a blanket tax determination for everything a company offers. Swaps and certain other instruments fall outside Section 1256. IRS Publication 550
For qualifying investment positions, gains and losses generally receive 60% long-term and 40% short-term capital treatment, irrespective of actual holding period. Open positions are generally deemed sold at fair market value on the last business day of the tax year. Thus, a contract without expiration can still produce annual taxable gains before the trader closes it. Hedging and other special rules can alter the result. IRS Publication 550
For example, an eligible $10,000 net gain generally divides into $6,000 long-term and $4,000 short-term components. That allocation can reduce federal tax compared with an entirely short-term gain, but the savings depend on the taxpayer’s circumstances. Annual marking also requires liquidity planning when gains remain invested.
Investors generally report Section 1256 results on Form 6781, carrying the applicable amounts into Schedule D. The form’s instructions address the 60/40 calculation and straddle complications; an exchange account statement does not replace the taxpayer’s filing obligation. IRS Form 6781 guidance, Form 6781 and instructions
Spot crypto held for investment generally follows property capital-gains principles, with holding period and basis determining the result. Form 1099-DA is broker information reporting, not a special tax regime: taxpayers generally reconcile applicable transactions on Form 8949 and Schedule D. The 2026 instructions distinguish gross-proceeds reporting from basis reporting for covered and noncovered assets. IRS Form 1099-DA instructions
Offshore perpetuals should not automatically be assigned either Section 1256 treatment or spot treatment. Their contractual classification, funding flows, and applicable rules require separate analysis. Nor does every offshore venue issue Form 1099-DA. The practical distinction is that a familiar offshore product name establishes neither 60/40 eligibility nor the correct reporting form.
Customer protection: segregation and clearing have limits
In the conventional US futures structure, the DCM operates the market, an FCM carries customer accounts, and a derivatives clearing organization manages cleared obligations. Under CEA Section 4d and implementing rules, futures customer funds must be segregated from the FCM’s own money. This restricts their use and gives customers a bankruptcy preference, but a shortfall can still leave customers exposed to insolvency losses. Segregation is not deposit insurance. CFTC customer-fund guidance
A DCO’s performance guarantee is backed by collateral, financial resources, and default-management arrangements. Depending on its rules, resources can include capital, guaranty-fund contributions, and assessments. This reduces bilateral counterparty exposure; it is not a government promise to reimburse trading losses. CFTC clearing financial-resource rules
Margin requirements constrain leverage through required collateral, rather than one universal leverage limit covering every US perpetual. Traders must examine the exchange, clearinghouse, and broker requirements applicable to their account. Additional margin demands can become consequential precisely when liquidity deteriorates.
Offshore safeguards work differently. Bybit describes an insurance fund that absorbs liquidation shortfalls, with auto-deleveraging available when the fund cannot cover losses. Binance also describes limits to insurance-fund coverage. Such arrangements should not be mistaken for Section 4d segregation or a US clearing guarantee. Bybit insurance-fund explanation, Binance insurance-fund explanation
High leverage can amplify forced selling: adverse prices trigger liquidations, which consume order-book liquidity and worsen execution for subsequent orders. Regulated infrastructure can improve risk management without eliminating this market mechanism.
Comparing venues and preparing an account
Coinbase Derivatives and Bitnomial belong in the US exchange comparison, while Kraken can provide an access channel rather than being the listing exchange for a particular contract. Kraken’s specifications describe Bitnomial-listed perpetuals without expiration. That documentation alone does not establish today’s availability for every customer or symbol. The commercial question is now whether domestic perpetual markets can combine dependable execution with their legal and tax advantages. That is an empirical test of liquidity, funding, and operational resilience. October 20 closed a specific procedural window; the longer-term competition will be decided contract by contract.
